Brazen imitation wins Plagiarius negative award In early February, Chinese manufacturer Wenzhou Haibao was the runner-up winner of the Plagiarius negative award for its imitation of Kärcher’s HD 6/15 C pressure cleaner. The negative award was announced at the Ambiente con- sumer goods expo in Frankfurt, marking the 38th edition of the Plagiarius Awards for companies who engage in brand and product piracy. Kärcher had sued the manufacturer in China last year and obtained a cease and desist order to stop production. In an ironic twist, a German trading company also took home a Plagiarius Award this year. Allersberg-based Otto Oehme GmbH won third place as the distributor of an imitation of the Sprintus Magic Click (originally manufactured by Sprintus GmbH) mop holder. Oehme rejects the allegation of plagiarism, as “both products are made from original Sprintus molds in China.” The courts are currently examining a sales exclusivity derived from Sprintus based on patent and industrial design protection. Sprintus strongly objects to Oehme’s representations, asserting that the plagiarized product was at no time manufactured using original Sprints molds, but is rather a pirated copy both in terms of color and function of the Magic Click product. “The courts will have to decide as to whether our position that this is a blatant infringe- ment of our patent and design rights is valid,” Sprintus stated. The Plagiarius initiative has been bestowing the feared negative award on an annual basis since 1997 to manufacturers and distributors of particularly egregious examples of product privacy and plagiarism. The goal of the initiative is to shine the spotlight on the unethical practices of pirates and copycats, and sensitize the industry, policymakers and consumers to this important problem.
